Terms of Use – SITA Sàrl (ReConnect)
Effective Date: March 1, 2025
These Terms of Use (“Agreement”) set out the legally binding terms and conditions for your use of ReConnect, a neuro-wellness solution by SITA Sàrl (“SITA,” “we,” “our,” or “us”).
Please read them carefully before using the Services. By accessing or using ReConnect in any way, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
1. Who We Are and How This Agreement Applies
ReConnect is provided by SITA Sàrl, a Swiss company headquartered in Lausanne, Switzerland. ReConnect includes:

The ReConnect Neuro-Cap wearable

The ReConnect mobile app (iOS/Android)

Related features, content, and services (together, the “Services”).
“You” or “your” means the individual using ReConnect, or the parent/guardian responsible for a teen account. If you create an account on behalf of an organization, you represent that you have the authority to bind that entity to this Agreement.
2. Registration and Accounts
To use ReConnect, you may need to create an account by providing your name and email.

You agree to provide accurate and current information and to keep it updated.

You are responsible for maintaining the confidentiality of your account and password.

You agree to notify us immediately if you suspect unauthorized use.

Parents/guardians are responsible for teen accounts they create and manage.
3. Eligibility

ReConnect is designed for users aged 16 and older.

Users under 16 must have a parent/guardian account and consent.

You may not use the Services where prohibited by law.
4. Use of the Services
We grant you a personal, non-exclusive, non-transferable license to use ReConnect for your own wellness purposes.
You agree not to:

Copy, sell, rent, sublicense, or distribute the Services.

Modify, reverse engineer, or interfere with the Services.

Use ReConnect for unlawful or harmful purposes.
5. Memberships and Fees
ReConnect may be offered as:

A device purchase with free app features; and/or
-
A subscription membership that provides premium features such as personalized neuro-training, family mode, and professional recommendations.

Subscription fees (“Membership Fees”) are disclosed during purchase.

Memberships auto-renew unless canceled.

You may cancel your subscription in your app account settings; cancellation is effective at the end of the current billing period.

Except as required by law, fees are non-refundable.
6. No Medical Advice
ReConnect is designed for wellness and lifestyle purposes only.

ReConnect is not a medical device.

The Services do not diagnose, treat, cure, or prevent any disease.

Always consult a qualified healthcare professional for medical questions or conditions.

Never disregard professional advice because of ReConnect data.

ReConnect is not for emergency use. If you experience a medical emergency, call 911 (U.S.) or your local emergency number.
7. Safety and Skin Sensitivities

Some users may experience mild skin irritation from wearables.
-
Check your skin regularly, keep the device clean, and discontinue use if irritation occurs.

If symptoms persist, consult your doctor.
8. User Content
You may submit content (feedback, survey responses, or progress data) (“User Content”).

You retain ownership of your User Content.

By submitting it, you grant SITA a license to use it to operate, improve, and promote the Services.

You agree not to upload unlawful, offensive, or infringing content.

We may remove User Content at our discretion.
9. Intellectual Property
All ReConnect technology, software, content, and trademarks are owned by SITA or its licensors. You have no rights to them except as expressly granted in this Agreement.
10. Disclaimer of Warranties
The Services are provided “as is” and “as available” without warranties of any kind.
We do not guarantee that ReConnect will be error-free, uninterrupted, or suitable for your health goals.
11. Limitation of Liability
To the fullest extent permitted by law:

SITA is not liable for indirect, incidental, special, or consequential damages, including loss of data or wellness outcomes.

Our total liability to you for any claim shall not exceed USD $100 or the amount you paid in the last 12 months, whichever is higher.
Some jurisdictions do not allow such limits; in those cases, liability is limited to the maximum extent allowed by law.
12. Indemnity
You agree to indemnify and hold harmless SITA and its affiliates from claims, damages, or costs arising from your misuse of the Services or breach of this Agreement.
13. Changes to Services and Terms

We may update or discontinue features of ReConnect.

We may modify these Terms at any time. Updates will be posted in the app or on our website with a new effective date.

Continued use means you accept the updated Terms.
14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Switzerland, without regard to conflicts of law.

If you are in the U.S., disputes will be resolved through binding arbitration under AAA Consumer Rules, unless prohibited by local law.

You agree to waive participation in class actions.
